  • Cookie or customer privacy settings where applicable;
  • Any other policies or notices published on the website.

If there is a conflict between these Terms of Service and a specific policy relating to a particular matter, the more specific policy will apply to that matter, except where applicable law requires otherwise.

4. Eligibility to Use the Website

By using the website or placing an order, you confirm that:

  • You have the legal capacity to enter into a binding contract;
  • You are legally permitted to use the payment method selected;
  • The information you provide is accurate and complete;
  • You will use the website only for lawful purposes;
  • You will comply with these Terms of Service and applicable law.

If you are under the age required to enter into a legally binding purchase contract, you may use the website only with the involvement and permission of a parent or legal guardian.

5. Customer Accounts

Some website features may allow or require you to create a customer account.

When creating or using an account, you agree to:

  • Provide accurate, current and complete information;
  • Keep your account details up to date;
  • Keep your login credentials confidential;
  • Use a secure password;
  • Notify us promptly if you believe your account has been accessed without permission;
  • Accept responsibility for activity carried out through your account where legally appropriate.

You must not share your password or allow another person to use your account in a manner that may cause harm, fraud or unauthorised activity.

We may restrict or suspend account access where we reasonably believe that:

  • The account has been compromised;
  • False information has been provided;
  • The account is being used fraudulently;
  • The account is being used in breach of these Terms of Service;
  • Restriction is necessary to protect the customer, Lakato Commerce or another person.

6. Product Information

We make reasonable efforts to ensure that product descriptions, images, measurements, materials, colours and other product information are accurate.

However:

  • Product colours may appear differently depending on the device, screen settings and lighting conditions;
  • Measurements may be approximate;
  • Minor production differences may occur;
  • Natural and woven materials may contain variations in texture, weave, shade or finish;
  • Packaging may differ from images shown on the website;
  • Product photographs may include decorative items that are not part of the product unless expressly stated.

A minor variation that does not materially affect the product's quality, appearance or intended use will not necessarily mean that the product is faulty or not as described.

This does not affect your legal rights where a product is materially different from its description, faulty, not of satisfactory quality or not fit for its normal purpose.

7. Product Measurements and Fit

Customers are responsible for reviewing the available size, measurement and fit information before placing an order.

The fit of headwear may vary depending on:

  • The customer's head measurement;
  • The shape of the customer's head;
  • The product material;
  • The design and structure of the crown;
  • The presence of an adjustable strap, band or fastening;
  • Normal production tolerances.

A product will not automatically be considered faulty solely because it does not fit a particular customer, provided that it corresponds with the measurements and description displayed on the website.

Customers should not stretch, steam, cut, wash, reshape or alter a product before requesting a return.

8. Product Availability

All products are subject to availability.

Adding a product to your shopping cart does not reserve that product.

A product may become unavailable before an order is accepted, including because of:

  • Stock discrepancies;
  • Simultaneous orders;
  • Supplier or fulfilment issues;
  • Product damage discovered before dispatch;
  • Technical errors;
  • Discontinuation of the product.

If a product becomes unavailable after you place an order, we may:

  • Contact you regarding an alternative product;
  • Remove the unavailable product from the order;
  • Cancel the affected product or order;
  • Issue an appropriate refund.

We will not substitute a materially different product without your agreement.

9. Placing an Order

You may place an order by selecting products, adding them to your shopping cart and completing the checkout process.

Before submitting an order, you are responsible for checking:

  • The products selected;
  • The selected size, colour and style;
  • The quantity;
  • The billing information;
  • The delivery address;
  • The selected delivery method;
  • The total price;
  • Any promotional code or discount;
  • The payment information.

By submitting an order, you are making an offer to purchase the products shown at checkout in accordance with these Terms of Service.

10. Order Confirmation and Contract Formation

After you place an order, you may receive an automated email acknowledging that we have received it.

An order acknowledgement does not necessarily mean that your order has been accepted.

The purchase contract is normally formed when we:

  • Send you confirmation that the order has been accepted or dispatched; or
  • Dispatch the ordered products, whichever occurs first.

We may contact you before accepting an order if additional information or payment verification is required.

If we cannot accept an order, we will notify you and refund any amount already collected for the cancelled order or product.

11. Our Right to Refuse or Cancel an Order

We may refuse, restrict or cancel an order where reasonably necessary, including where:

  • A product is unavailable;
  • The price or product information contains an obvious error;
  • Payment is declined or cannot be verified;
  • The billing or delivery information appears incorrect or incomplete;
  • We reasonably suspect fraud, abuse or unauthorised payment activity;
  • The order appears to be placed for unlawful purposes;
  • The order exceeds reasonable purchasing limits;
  • The delivery location cannot be served;
  • Acceptance would breach applicable law or a payment provider requirement;
  • A technical or stock-management error occurred.

We will not cancel an accepted consumer order without a reasonable basis.

Where we cancel an order after payment has been received, we will refund the cancelled amount to the original payment method.

12. Prices

Product prices are displayed on the website in the currency selected or shown during your shopping session.

The total price payable will be displayed during checkout before you submit the order.

The total may include:

  • The product price;
  • Applicable taxes;
  • Delivery charges;
  • Any selected premium delivery service;
  • Discounts or promotional reductions;
  • Other charges clearly disclosed before checkout is completed.

Prices may change at any time, but a price change will not normally affect an order that we have already accepted.

13. Pricing and Website Errors

We make reasonable efforts to ensure that prices and product information are accurate.

However, errors may occasionally occur.

If we discover an obvious pricing or product-information error before accepting an order, we may:

  • Contact you to confirm whether you wish to proceed at the correct price;
  • Cancel the affected product or order;
  • Issue a refund if payment has already been collected.

We are not required to supply a product at an obviously incorrect price where the error would reasonably have been apparent to the customer.

14. Taxes and Duties

Applicable taxes will be calculated or displayed during checkout where required.

For deliveries outside the territory from which the products are dispatched, the recipient may be responsible for:

  • Import taxes;
  • Customs duties;
  • Customs clearance charges;
  • Local handling fees;
  • Other charges imposed by authorities or delivery providers.

Unless expressly stated at checkout, these charges are not included in the product or delivery price and are not controlled by Lakato Commerce.

Customers are responsible for checking any import restrictions and charges that may apply at the delivery destination.

15. Payment

Available payment methods will be displayed during checkout.

Payments may be processed by Shopify and third-party payment service providers.

By submitting payment information, you confirm that:

  • You are authorised to use the selected payment method;
  • The payment information is accurate;
  • The payment method has sufficient funds or credit;
  • The transaction is lawful.

Payment may be authorised or collected when the order is placed, accepted or prepared for fulfilment, depending on the payment method and checkout process.

We do not normally receive or store complete payment card numbers or card security codes.

16. Payment Verification

Orders may be subject to payment, identity and fraud-prevention checks.

We or our service providers may request additional information where reasonably necessary to:

  • Verify the payment method;
  • Confirm the identity of the customer;
  • Confirm the billing or delivery address;
  • Protect against unauthorised transactions;
  • Meet legal or payment provider requirements.

An order may be delayed, refused or cancelled if the requested verification cannot be completed.

Customers must not send full card numbers, security codes or account passwords by email.

17. Promotional Codes and Discounts

Promotional codes, discount codes and special offers are subject to any conditions stated at the time of the promotion.

Unless otherwise stated:

  • A promotional code may be used only once per customer or order;
  • Only one promotional code may be used per order;
  • Promotional codes cannot be exchanged for cash;
  • Promotional codes cannot be applied after an order has been submitted;
  • Promotional codes may have an expiry date;
  • Some products or collections may be excluded;
  • Minimum order values may apply;
  • Delivery charges may be excluded from the discount.

We may reject or cancel a promotional code where it has been used fraudulently, unlawfully or contrary to the applicable promotional conditions.

If an order is partially returned, a discount may be recalculated where the remaining order no longer meets the original promotion requirements, to the extent permitted by law.

18. Delivery

Available delivery methods, charges and estimated delivery times will be displayed on the website or during checkout where applicable.

Delivery times are estimates unless we expressly agree to a guaranteed delivery date.

An estimated delivery period begins after:

  • The order has been accepted;
  • Payment has been authorised;
  • Any necessary verification has been completed;
  • The order has entered processing.

Processing time and delivery transit time are separate periods.

19. Delivery Delays

Deliveries may be delayed by circumstances outside our reasonable control, including:

  • Carrier delays;
  • Severe weather;
  • Transport disruption;
  • Customs processing;
  • Public holidays;
  • Industrial action;
  • Incorrect or incomplete delivery information;
  • Security checks;
  • Events affecting suppliers or fulfilment providers;
  • Other events beyond our reasonable control.

Where a significant delay occurs, we will take reasonable steps to provide information and assist with the delivery.

Your legal rights regarding delayed delivery are not affected.

20. Delivery Address

Customers are responsible for providing a complete and accurate delivery address.

Before submitting an order, you should check:

  • The recipient's full name;
  • The building number or name;
  • The street address;
  • The town or city;
  • The postcode;
  • The destination country where applicable;
  • The telephone number where requested.

Contact us promptly if you discover an error in the delivery address.

We cannot guarantee that an address can be changed after the order has entered processing, packing or dispatch.

We are not responsible for delivery failure caused solely by inaccurate information supplied by the customer, except where responsibility cannot legally be excluded.

21. Delivery to Another Person

You may request delivery to another person or address where this option is available.

You are responsible for ensuring that:

  • The recipient has agreed to receive the parcel;
  • The delivery details are accurate;
  • The recipient can accept or collect the parcel;
  • The order does not violate local law or delivery restrictions.

Delivery to the nominated recipient or authorised person at the supplied address may be treated as delivery to you.

22. Delivery Instructions and Safe Places

Where a carrier allows delivery instructions, a parcel may be left:

  • At a nominated safe place;
  • With a neighbour;
  • At a collection point;
  • In another location selected through the carrier's service.

Where the customer independently instructs the carrier to leave a parcel in a particular place or redirect it, responsibility may pass in accordance with applicable law and the carrier arrangement.

Customers should select only secure and suitable delivery locations.

23. Risk and Ownership

Responsibility for loss or damage to consumer goods normally passes to the customer when the goods are delivered into the physical possession of:

  • The customer;
  • A person identified by the customer to receive the goods;
  • Another person where responsibility legally passes under the selected delivery arrangement.

Legal ownership of the products normally passes to the customer after full payment has been received and the products have been delivered.

24. Tracking Information

Where tracking is available, we may provide a tracking number or tracking link.

Tracking information is supplied by the delivery provider and may not update immediately.

Customers are responsible for monitoring tracking information and responding to carrier delivery or collection notifications.

25. Undeliverable and Unclaimed Parcels

A parcel may be returned to us because:

  • The delivery address was incorrect or incomplete;
  • The recipient was unavailable;
  • The parcel was not collected;
  • Delivery was repeatedly unsuccessful;
  • The recipient refused the parcel;
  • Customs or import charges were not paid;
  • The parcel could not be delivered for another reason outside our control.

If a parcel is returned to us, we may contact the customer to arrange:

  • Re-dispatch;
  • Address correction;
  • Cancellation;
  • A refund where applicable.

Where legally permitted and where the failed delivery was caused by information or instructions supplied by the customer, reasonable return or re-dispatch costs may be charged or deducted from the refund.

26. Lost Parcels

If tracking indicates that a parcel has not been delivered within the expected period, contact us at sales@lakatocommerce.com.

We may need to investigate the matter with the delivery provider before confirming the appropriate resolution.

The customer may be asked to provide:

  • The order number;
  • The delivery address;
  • Confirmation that the parcel has not been received;
  • Information regarding household members, neighbours or safe places;
  • Other information reasonably required for the carrier investigation.

Depending on the investigation and applicable rights, we may arrange a replacement, refund or another appropriate resolution.

27. Damaged Parcels and Products

Customers should inspect the parcel and products as soon as reasonably possible after delivery.

If a product or parcel arrives damaged, contact us promptly and provide:

  • The order number;
  • A description of the damage;
  • Photographs of the complete product;
  • Close-up photographs of the damage;
  • Photographs of the outer parcel;
  • Photographs of the internal packaging;
  • Photographs of the shipping label.

Do not discard the product or packaging before we have reviewed the matter and provided instructions.

28. Faulty or Incorrect Products

If a product is faulty, damaged, materially different from its description or incorrect, contact us promptly.

Depending on the circumstances and your legal rights, the available remedy may include:

  • A replacement;
  • A repair where appropriate;
  • A full refund;
  • A partial refund;
  • Reimbursement of reasonable return costs;
  • Another remedy agreed with you.

Customers should not wash, steam, alter, repair or otherwise modify an allegedly faulty product before contacting us.

29. Consumer Product Rights

Products supplied to consumers must meet applicable legal standards, including being:

  • Of satisfactory quality;
  • Fit for their normal purpose;
  • As described;
  • Consistent with relevant information provided before purchase.

Nothing in these Terms of Service excludes or restricts any consumer right or remedy that cannot legally be excluded or restricted.

30. Cancelling an Order Before Dispatch

If you wish to cancel or change an order before dispatch, contact us as soon as possible at sales@lakatocommerce.com.

We will make reasonable efforts to process the request, but we cannot guarantee changes or cancellation after the order has entered processing, packing or dispatch.

If the order has already been dispatched, you may need to receive it and use the return process described in our Return and Refund Policy.

31. Right to Cancel a Distance Purchase

Consumers may have the legal right to cancel an online purchase without providing a reason.

The standard cancellation period is normally 14 days beginning on the day after the customer, or a person nominated by the customer other than the carrier, receives the product.

If one order contains multiple products delivered separately, the period normally begins on the day after the final product is received.

To exercise the cancellation right, contact us within the applicable period at: sales@lakatocommerce.com.

Further information regarding cancellations, returns, return costs and refunds is contained in our Return and Refund Policy.

32. Return Conditions

Returned headwear should be handled only as much as reasonably necessary to inspect its nature, characteristics and fit.

Returned products should, where reasonably possible:

  • Be unworn other than for a brief indoor fitting;
  • Be clean and free from signs of extended use;
  • Be free from makeup, hair products, perfume, smoke and other odours;
  • Include product labels, tags and accessories;
  • Retain their original shape and structure;
  • Be packed securely to protect the crown and brim;
  • Not have been washed, steamed, stretched, altered or reshaped.

Where permitted by law, a refund may be reduced to reflect a loss in product value caused by handling beyond what would reasonably be permitted in a physical shop.

33. Personalised and Custom-Made Products

Products made to a customer's specifications or clearly personalised may be excluded from the standard change-of-mind cancellation right where an applicable legal exception applies.

This may include products that have been:

  • Personalised;
  • Monogrammed;
  • Custom-sized;
  • Altered at the customer's request;
  • Made according to customer-selected specifications.

This does not affect your rights where the product is faulty, damaged, incorrect, materially not as described or not made in accordance with the agreed specifications.

34. Exchanges

We do not guarantee direct exchanges.

If you require a different size, colour or style, contact us before returning the original product.

Depending on availability, we may:

  • Arrange an exchange;
  • Ask you to return the original product for a refund;
  • Ask you to place a new order;
  • Offer another suitable solution.

A replacement product is not reserved until we confirm the exchange in writing.

35. Refunds

Approved refunds will normally be issued to the original payment method.

The refunded amount may include:

  • The amount paid for the returned product;
  • Applicable taxes;
  • The standard delivery charge where required by law;
  • Approved return costs for faulty, damaged or incorrect products where applicable.

The refunded amount may exclude:

  • Premium delivery costs above the standard delivery charge;
  • Change-of-mind return shipping costs;
  • Third-party customs or import charges;
  • Any lawful deduction for diminished value;
  • The value of missing products or accessories.

Further information is contained in our Return and Refund Policy.

36. Refund Processing Times

Approved consumer cancellation refunds will be processed without unnecessary delay and within the period required by applicable law.

We may withhold a refund until:

  • We receive the returned product; or
  • You provide reliable evidence that the product has been sent back, where applicable.

After we issue a refund, the payment provider or bank may require additional time to display the funds in your account.

37. Gift Cards and Store Credit

Where gift cards or store credit are made available, additional conditions may apply.

Unless required by law:

  • Gift cards and store credit are not redeemable for cash;
  • Gift cards must be used before their stated expiry date where an expiry is legally permitted;
  • Lost or stolen gift card codes may not be replaceable;
  • Gift cards may not be resold or used fraudulently;
  • Refunds for purchases made with store credit may be returned to store credit.

38. Product Care

Customers are responsible for following any product care instructions supplied with the product or displayed on the website.

Depending on the material and design, headwear may be damaged by:

  • Machine washing;
  • Tumble drying;
  • Ironing;
  • Excessive steaming;
  • Exposure to rain or moisture;
  • Exposure to direct heat;
  • Prolonged direct sunlight;
  • Crushing or folding;
  • Unsuitable cleaning chemicals;
  • Incorrect storage.

Damage caused by misuse, unsuitable care, accidents, normal wear and tear or unauthorised alteration is not a manufacturing fault.

You may use the website only for lawful personal or commercial purchasing purposes consistent with these Terms of Service.

You must not:

  • Using an unauthorised payment method;
  • Providing false billing or delivery information;
  • Making false claims that a parcel was not delivered;
  • Returning a different product from the product purchased;
  • Returning used or deliberately damaged products as new;
  • Abusing promotional codes;

Where reasonably necessary, we may:

  • Request additional verification;

  • Restrict account access;
  • Provide relevant information to payment providers or authorities where legally permitted.

  • Threats of violence;
  • Discriminatory abuse;
  • Repeated harassment;
  • Malicious content;
  • Unlawful demands;
  • Attempts to obtain unauthorised information;
  • Other seriously abusive conduct.

Restricting abusive communications will not remove any consumer rights relating to a valid order or complaint.

42. Intellectual Property Rights

The website and its content may include:

  • Text;
  • Product descriptions;
  • Photographs;
  • Graphics;
  • Logos;
  • Brand names;

You may not use our branding without prior written permission in a way that:

  • Creates confusion;
  • Suggests endorsement or affiliation;
  • Misrepresents the origin of products;

  • Violates applicable intellectual property law.

44. Product Reviews and Submitted Content

Where the website allows reviews, comments, photographs or other submissions, you retain any ownership rights you may have in your original content.

By submitting content for publication, you grant Lakato Commerce a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, format and publish that content for operating, promoting and improving the store, subject to applicable law and our Privacy Policy.

You confirm that submitted content:

  • Does not contain malicious software;
  • Does not contain confidential payment information;
  • Does not contain misleading advertising or spam.

We may remove or decline to publish content that breaches these requirements.

We will not remove a genuine negative review solely because it is negative, but we may moderate content that is unlawful, irrelevant, abusive, false or otherwise inappropriate.

45. Third-Party Tools and Services

The website may use or provide access to services supplied by third parties, including:

  • Shopify;
  • Payment providers;
  • Delivery providers;
  • Analytics services;

Third-party services may be subject to their own terms and privacy policies.

We are not responsible for the independent acts or policies of third parties, except where responsibility cannot legally be excluded.

46. Third-Party Links

A link does not necessarily mean that Lakato Commerce:

  • Controls the third-party website;
  • Approves all of its content;
  • Guarantees its products or services;
  • Accepts responsibility for its privacy or security practices.

You should review the applicable terms and privacy policy before using a third-party website or providing personal information.

  • Maintenance;
  • Security updates;

We may modify, suspend or discontinue website features where reasonably necessary.

This does not affect obligations relating to orders already accepted.

We may correct errors, update information or change website content without prior notice.

Customers should review product details and make their own purchasing decision based on their requirements.

Nothing in this section limits responsibility for inaccurate product descriptions or mandatory consumer rights.

52. Limitation of Liability

Nothing in these Terms of Service excludes or limits liability where exclusion or limitation would be unlawful.

This includes liability for:

  • Death or personal injury caused by negligence;
  • Fraud or fraudulent misrepresentation;
  • Breach of mandatory consumer rights;
  • Any other liability that cannot legally be excluded or limited.

Subject to the above, Lakato Commerce is not responsible for losses that:

  • Were caused by events outside our reasonable control;
  • Relate to independent third-party services outside our control;
  • Are business losses arising from a consumer purchase, such as lost profits or lost commercial opportunities.

For business customers, to the extent permitted by law, our total liability relating to an order will not exceed the total amount paid for the order giving rise to the claim.

The preceding limitation does not apply where it would be unlawful or unreasonable to apply it.

53. Consumer and Business Customers

These Terms of Service primarily apply to consumers purchasing products for personal use.

If you purchase products wholly or mainly for business, resale or professional purposes, you must inform us where reasonably relevant.

Certain consumer protections may not apply to business purchases.

Where such an event affects an accepted order, we will take reasonable steps to minimise the effect and communicate with the customer.

Where performance becomes impossible or is significantly delayed, you may have the right to cancel and receive an appropriate refund.

55. Indemnity for Unlawful Business Use

If you use the website for business purposes, you agree, to the extent permitted by law, to compensate Lakato Commerce for reasonable losses, liabilities and costs caused by your unlawful use of the website or material breach of these Terms of Service.

This section does not apply to ordinary consumer use and does not limit mandatory consumer rights.

57. Chargebacks and Payment Disputes

Customers are encouraged to contact us before starting a payment dispute or chargeback so that we have an opportunity to investigate and resolve the matter.

A chargeback does not automatically remove an obligation to return a product where a return is legally or contractually required.

When responding to a payment dispute, we may provide the payment provider with relevant information, including:

  • Order details;
  • Payment records;
  • Delivery information;
  • Tracking and delivery confirmation;
  • Customer communications;
  • Return and refund records;
  • Applicable website policies.

Nothing in this section prevents a customer from exercising their legal rights through their bank or payment provider.

58. Suspension and Termination

We may suspend or terminate access to the website or a customer account where reasonably necessary because of:

  • Fraud or suspected fraud;
  • Unlawful activity;
  • Serious or repeated breaches of these Terms of Service;
  • Threats to website security;
  • Abuse of employees, contractors or service providers;
  • Misuse of account or payment functionality.

Suspension or termination will not remove rights and obligations relating to orders already placed, payments, returns, refunds, intellectual property, liability or legal claims.

59. Changes to These Terms

We may update these Terms of Service to reflect changes to:

  • Our products;
  • Our website;
  • Shopify functionality;
  • Payment methods;
  • Delivery and fulfilment arrangements;
  • Business operations;
  • Applicable legal or regulatory requirements.

The updated version will be published on this page with a revised "Last updated" date.

The Terms of Service that normally apply to an order are the terms displayed when the order was placed, unless:

  • A later change is required by law;
  • The customer agrees to the change;
  • The change provides the customer with more favourable rights.

60. No Waiver

If Lakato Commerce does not immediately enforce a right under these Terms of Service, this does not mean that the right has been waived.

A waiver is effective only where it is clearly given and applies only to the specific circumstances for which it was given.

61. Severability

If any provision of these Terms of Service is found to be unlawful, invalid or unenforceable, that provision will be interpreted or removed only to the minimum extent necessary.

The remaining provisions will continue in effect.

62. Transfer of Rights

We may transfer our rights and obligations under these Terms of Service to another organisation as part of a lawful business transfer, restructuring or similar arrangement.

Such a transfer will not reduce your mandatory consumer rights.

Customers may transfer their rights under an order only where permitted by law or with our written agreement.

63. Third-Party Rights

Unless expressly stated otherwise, these Terms of Service are between the customer and LAKATO COMMERCE LTD.

No other person has the right to enforce these Terms, except where applicable law provides otherwise.

64. Entire Agreement

These Terms of Service, together with the policies and information referred to in them, form the agreement between you and Lakato Commerce regarding your use of the website and purchase of products.

Nothing in this section excludes liability for fraud or prevents a customer from relying on information that forms part of the purchase contract under applicable consumer law.

65. Governing Law

These Terms of Service and contracts for purchases from Lakato Commerce are governed by the laws of England and Wales.

If you are a consumer living elsewhere, you may also benefit from mandatory consumer protections that apply in your usual country of residence.

66. Jurisdiction

The courts of England and Wales will have jurisdiction over disputes arising from these Terms of Service or purchases from Lakato Commerce.

If you are a consumer living in another part of the country or another jurisdiction, you may also have the right to bring proceedings in the courts available to you under mandatory applicable law.
